Proposed Bsl In Nova Scotia

PLEASE CROSSPOST!!

The DLCC has now verified that the Nova Scotia Legislature has grouped together several unrelated Bills as a "house keeping" measure to clear the tables before the summer break.

Inside this "new" Bill, you will read that ALL NOVA SCOTIA MUNICIPALITIES will be enabled to declare a dog(s) fierce and dangerous by BREED not by their actions, bottom line is they will be enabled to enact BSL at their discretion.

It has already gone through a First and second Reading on April 23, May 5 and 13th/08

The portion of Bill 138 Clauses 6 through 8 must be removed,struck down.Otherwise BSL will be a valid option for any NS municipality.

The original Dangerous Dog Bill,created by Lloyd Hines and Dan McDougall of Guysborough County fame was defeated last year.It has now resurfaced,hidden amongst several unrelated and previously unpassed Bills.

This could be a battle as your MLA may want any one of the several unrelated portions of this Bill to be passed.

Therefore it is imperative that you contact your MLA in writing,on the phone,fax or by any other means and demand that Clauses 6-8 be removed and/or that a public hearing on these Clauses be scheduled.

First Reading: April 28, 2008

Clauses 6 to 8 amend the by-law powers in the Municipal Government Act respecting dogs.

6 Subsection 175(1) of Chapter 18 is amended by

(a) adding ", including a fierce, dangerous or restricted dog" immediately after "dog" in the second line of clause (b);

(b) striking out clauses (e) and (f) and substituting the following clauses:

(e) defining fierce, dangerous or restricted dogs, including defining them by breed, cross-breed, partial breed, behaviour or type;

(f) regulating the keeping of fierce, dangerous or restricted dogs, including requiring spaying or neutering, liability insurance, warning signs, physical controls on or off the owner's property or training requirements;

(c) adding immediately after subclause (h)(iv) the following subclause:

(iva) in respect of which a requirement imposed by a by-law has not been complied with,

and

(d) adding immediately after clause (i) the following clause:

(ia) requiring the owner of a dog to report whether a dog has been spayed or neutered, the breed or type of dog and whether the owner has liability insurance for any injury or damage the dog may cause, including providing proof of such insurance;

7 Subsection 176(1) of Chapter 18, as amended by Chapter 9 of the Acts of 2003, is further amended by adding ", that is restricted by by-law and any of the requirements of the by-law have not been met" immediately after "madness" in the fifth line.

8 Section 177 of Chapter 18, as amended by Chapter 9 of the Acts of 2000, is further amended by adding ", that is restricted by by-law and any of the requirements of the by-law have not been met" immediately after "dangerous" in the second line.

Sarah, thank you so much for cross posting. That we have only been made aware of this insanity just this week and
have that much time or less to try and derail it is heartsickening.

I would like to repost part of this and ask that those outside of NS become involved as well. Even though it may not be
in your province, the potential is there for it to become widespread. If you are in Ontario, you already understand what
we are facing. Should Mr. Hines (Guysborough) have his way, we would not only see a pitbull ban as it was instituted in
Ontario, we could be facing multiple breed/crossbreed TOTAL ban..........he wants "these dogs" GONE !!! He has already
accomplished this in his municipality with pits.........they are not allowed to exist........no grandfather clause!!

Please help us turn Mr. Hines' dream into his worst nightmare.

To all those concerned about Bill 138 in NS

The DLCC would like to thank everyone who has written to government and expressed their concerns........

We have now entered into another phase of the process.

Bill 138 is before the Law Amendments Committee.

This committee is already aware of the public opinion about the amendments (from the MLA's) therefore it is NOT necessary to contact the government or this committee further.This will place us in a better position to facilitate open dialogue .

So hang tight,we will apprise everyone of any new developments as they unfold or you can visit..........

Saradog, again THANK YOU so much!!! Have been checking all day to see what word is out...........in a way it's a relief, in another frightening. I know MacDonald and Dexter have stated their parties will not support the Bill with those clauses included, but when it comes to politics.......I don't hold my breath and I sure as heck don't place bets.

Only praying for the best outcome. :

NOW the really HARD part is coming into play - as the newspaper says the issue will go back to the UNSM - which clearly has members that are pro BSL - How do we educate them to implement and enforce dangerous dog bylaws that are not breed specific in nature and how do we lobby to get the bans that exist in some of our municipalities lifted?
