That's just incredible--what an ill-conceived bylaw! No one living there could ever buy a puppy because how can you predict adult height?! And is that height to the top of the head, the withers, the shoulder...?? If it's written imprecisely, is there some way they can get it overturned in the municipal court system? I realize that would take more time than they have but perhaps the court could stay the fines and the move until the decision was made. It would be cheaper just to move, though.
Best of luck to your friends, Soundy! Are they having any luck finding a new place?

They've been sort-of looking for a while, but now of course, the house hunting has ramped up (they really need a house with a yard and no strata).
Stupid thing is, they're pretty sure the council is more concerned with the fact Chewy *looks* like a pitbull - they got ahold of copies of strata council meeting minutes going back a few months, and the council first discussed getting rid of him back in February, when he was still well under the height limit... they didn't send the first warning letter until April, AFTER he'd grown past the 14" (measured at the shoulder, which I believe is the "standard" height measurement for dogs). So it really appears that the height thing is just an excuse they're using to oust what they see as an "undesirable breed" (despite there not actually being any pitbull in the mix!). The fact that there are other over-height dogs in the complex that haven't been harassed, speaks volumes.

I wonder if they have a by-law against kids who may grow over 5'6", or babies who cry after 6pm, or couples who decide to hold hands on their front lawn, a family who's skin is a shade darker than allowed?????where will it stop?????
Again, this is another perfect example how ignorant and just plain stupid people can become.... |

If everyone who had an 'out of height compliance' dog in the complex came forward, they might change the rule--yes, the commission could also kick all those tenants out or try to fine them as well, but that would sure leave them with an awful lot of empty units to fill, wouldn't it?

Great point! I hope it makes the council members think a little bit...

I wonder how a pure bred 14" Staffie would go in that situation? It's a Bullie type breed but meets the height limit.
