Prosecutors say a man’s wife caught him having sex with their dog. He might be the first in the state charged under a new animal cruelty law.

A Spanaway man is the first person in Pierce County – and possible the first in the state – charged under a new section of the state’s animal cruelty law that makes bestiality a felony.

Pierce County prosecutors say Michael Patrick McPhail, 26, had sex with his family’s dog Wednesday.Deputy prosecutor Karen Watson charged the father of two Thursday with one count of first-degree animal cruelty – a crime that could mean up to a year in jail if he’s convicted.

McPhail was arraigned Thursday afternoon in Pierce County Superior Court and a not-guilty plea was entered on his behalf. Judge Katherine Stolz ordered him held in the Pierce County Jail in lieu of $20,000 bail.
Stolz set trial for Dec. 11.

According to a Pierce County Sheriff’s Department report, McPhail’s wife told investigators that she caught her husband on the back porch about 9:30 p.m. Wednesday having intercourse with their 4-year-old female pit bull terrier.

She took photos of the act, the report says. The bestiality law, which took effect in June, was prompted by a case near Enumclaw in which a man died after having sex with a horse.

Before the law was enacted, Washington was one of 14 states where bestiality had not been explicitly prohibited.

I only pass on what I've read. . .the News Tribune is a ligit. newspaper, too, part of the McKlatchy empire. Kind of shocking part of my morning online newspaper read, tho. . .

URGENT UPDATE:
Update as of 3:26pm PST: We have spoken with the District Attorney in the McPhail case who assures us that the female dog (the victim) will not be euthanized as she is considered "evidence" and will be held until conviction or acquittal. The male dog, it appears, may be placed for adoption.

Both dogs are being held at the local humane society (as the alleged crime took place in their area). It is Pasado's concern that a dog, already deemed "aggressive" be kept in a kennel for months, even years, as a legal case makes its way through the courts. The last cruelty case Pasado's worked on left a dog in a kennel for 18 months.

Pasado's is offering Animal Control (under whose purview this case falls under) to release both dogs to Pasado's Safe Haven provided that we pay for any bond necessary to insure the public's safety. Additionally, the local humane society who may adopt out the male, does not perform home checks, which Pasado's does. We could assure that this dog will be placed in a loving home (We also do requisite unannounced checks following adoption.)

Furthermore, releasing the female dog to Pasado's Safe Haven would provide the animal the opportunity for professional behavioral assessment and training. We would assume all costs for this. We are now in communication with Cesar Milan, National Geographic Channel's "The Dog Whisperer" who is a specialist in pitbull behavior and aggression. Cesar helped Pasado's with dogs we rescued in the aftermath of Hurricane Katrina. Neither he nor Pasado's believes that truly vicious dogs should be adopted. But we also believe that every dog should be given a fair chance. This female pup shouldn't be locked in a kennel without daily loving and training. Please stay tuned to this website for updates.

As of today:
Pasado's Safe Haven is asking for people from across the country to help save a dog who was the victim of bestiality who now faces death!

This year, Pasado's wrote and passed the first anti-bestiality felony law in Washington State. This past week, Michael Patrick McPhail was arraigned in court for having had sexual relations with his pitbull on his back porch. His wife caught him in the act and photographed the act with her cell phone. McPhail's arrest was the first under the new Pasado's Safe Haven Bestiality Law.

Pasado's Safe Haven offered to take both the dog who was hurt and another pitbull the family owned. Local animal control authorities confiscated both dogs. They have stated that the female, who had been violated by McPhail, has a history of aggression (who could blame her!) and may need to be euthanized.

What to do if this dog is truly aggressive?
First, we won't just give up without a try. We have a wonderful working relationship with Cesar Millan, National Geographic's "The Dog Whisperer". Cesar specializes in aggressive pitbulls. If indeed she is aggressive. Working with someone who is compassionate and knows the breed is key. We believe why not try to help an animal before you "give up"?

What YOU can do to help:
Let the local media know that the nation cares about what happens to this dog - that we cannot allow her to be betrayed a second time in her life. Write to the following:
--Include your name and what state you live in
--Tell them that the new Pasado's Bestiality Law caught the man who violated his dog but this dog may be killed now!
--Ask them politely to follow this case. Pasado's Safe Haven has offered to take this dog and provide professional behavioral help.
--Pasado's will put up a bond to protect the public if needed.
--Why not give her a chance?

HISTORY OF CASE:
Last June Pasado’s Safe Haven staff stood next to Governor Gregoire as she signed SB6417 into law making Washington the 36th state to pass anti-bestiality legislation. Pasado’s Safe Haven wrote the statute language and worked with Senator Pam Roach and hundreds of supporters to make this deplorable practice a first degree animal cruelty felony.

This week a man was the first person charged under this new law after his wife caught him, on camera, sexually abusing their family pet on their porch. Michael Patrick McPhail was arraigned in a Pierce County courthouse after pleading not guilty to having sex with the
four year-old dog. If convicted, the twenty-six year-old father of two will face a maximum sentence of one year in jail and a $5,000 fine. The court can also order psychiatric counseling and treatment. Additional requirements can include restrictions on owning, harboring or residing in a household with animals. McPhail posted $300,000 bail and was released.

If you followed the passage of SB6417 on our website you likely know that psychiatrists categorize zoophilia (sex with animals) in the same family of sexual disorders as pedophilia and necrophilia. Aside from the deliberate cruelty inflicted on a defenseless animal, this behavior can devastate families and many times coexists with additional sexual disorders.

The now infamous Enumclaw case should be enough evidence to convince anyone that individuals who engage in zoophilia are unstable criminals. This was the incident that that precipitated passage of SB6417.

We’ll be following this case closely to see if District Attorney enforces the law we all
worked so hard so pass. If not, we’ll remind them and ask for your help. Stay tuned.

One slowish day at the clinic that I used to work at, the receptionist came to the surgery room where I was with this weird look on her face and trying not to laugh. She said that there was a man on the phone that had an interesting question that she didn't know how to handle so she came for advice. Well, turns out that the man had come home for lunch and found his teenage daughter having sex with the family dog on the couch. He was wondering what was going to happen to his daughter because of this. What she was going to "get". We told him that his daughter would be physically fine, but he should take her to their family dr to have her checked out and then get a psych. referal!

That is absolutely horrible and there was no reason for the receptionist to be laughing. That's a serious sign that something is wrong in that home and it should probably have been reported to the authorities. Who knows what has already happened to that girl at her age to make this happen and who knows what it would trigger in years to come.

Anytime someone hears or sees something like this, it should be reported. I can't believe how sick some people are or how others turn their backs. I think the wife in the above story did right by turning her husband in, but I do wonder how long this was happening before something was done.

I agree with Jesse's mommy -- this should be reported, this would send serious alarm bells ringing in my head, and I'm not even a health professionnal... I'd be worried this girl is being abused, if there's even a chance of it, it's no laughing matter....

I remember the guy who died having sex with the horse. As I recall he was indeed kicked to death or stepped on. As it turned out, there weren't any anti-bestiality crimes in Washington state at the time, so technically what he was doing wouldn't have been considered illegal, which is what prompted the state to hastily pass some laws.

Poor dog! Can they blame her for being aggressive? I hope they get a behaviorist other than Cesar to work with her, though, I don't think much of him and I think he might make her worse.

Lightbulb What an unfortunate illness

Wow! I luv my dog, but not that much! Thats insane...it's about time these pervs are being exposed. I have the cutest Japanese Chin/spaniel and i suspected an x-roommate of molesting her. It was strange because she would smell of baby-oil which he ironically preferred over lube(i was shocked). It must be a sad disease to have.! I have a good theory though, I believe these sick-os develop this behavior around puberty, mainly kids who are insecure about sex and are sexually frustrated. Anyway, this frustration is usually taken out on the family pet because it is a live object and it won't judge the performance, then i guess it becomes an unhealthy pleasure or secret infatuation as time goes, thats why i think adults into beastiality developed this problem because they "lost their virginity" to a pet and now they are attached to this activity into adulthood. (Similar to Child abusers in some cases, who as kids themselves engaged in sexual activities with other kids and, as time goes by they don't seem to get over this type of behavior which of course becomes a problem when they become adults...where as a kid with a normal sexual appetite just masters himself to thoughts of a crush or adult films to start off with, as their sexual tastes evolve with age. If one feels curious about it or just develops these behaviors all of a sudden then maybe they should get a mental evaluation. Well those are my thoughts and i'm not justifying this behavior just mainly trying figure the root of this illness.

Oh, and about the guy killed by the horse...he must have been on crack or something, I heard this a while back but it turns out this guy was gonna video tape his own Donkey show but with a horse because it has a bigger erection. Anyway it turns out the horse's erection went to far and damaged the guys insides, resulting in his death. Usually it's the other way around, where most commonly Dogs die after being abused because it's insides are damaged...Very unfortunate..

Bestiality, pedophiles and rapists are in the same category - it's not about the sex, it's sexual exploitation, dominance and control <-- that's it! Psychiatry should be mandatory for life - it's not cureable IMO

It appears there's alot more to this story then will ever know but it was suggested on a internet chat this farm was a destination for people looking to have sex with livestock. They also had chickens, sheep, goats, bulls and dogs.

James Tait's companion Kenneth Pinyan died of acute peritonitis after both were filmed raping a horse (an untreated bacterial infection). Apparently they trespassed onto this farm regularly where enforments obtained hundreds of hours of previous footage at this farm. Animal cruelty could not be established since the horse couldn't actually say whether or not it hurt (law at that time)

James Tait was convincted Nov 30'05 with misdemeanor, trespassing: 1 year suspended sentence, $300 fine, 8 hrs of community service and ordered no contact with his neighbor and their farm.

Because of this horrible case - on March 1st'06 Washington State Senate Bill 6417, the anti-bestiality bill, passed the House of Representatives 98-0 "Silence of Betrayal" is no more in this State

SEATTLE -- Last week's animal-abuse arrest of a convicted cocaine smuggler wasn't the first time authorities had found something linking him to bestiality.
A Monroe police commander said Monday that when Douglas Spink's sport utility vehicle was pulled over in 2005, Spink was strangely protective of a female German shepherd that was with him, and he had stickers on the car indicating he was an animal-man-love activist.

After doing his time, Spink moved to a crudely built compound in Whatcom County, near the Canadian border. He was arrested last week on charges of violating the terms of his supervised release from prison by engaging in animal cruelty and withholding information from probation officers about his travel and assets.

A 51-year-old tourist from Great Britain was on the property and was arrested for investigation of bestiality after agents found videos of him abusing dogs. Investigators seized dozens of animals from the compound -- horses, dogs and mice.

According to documents filed in Whatcom County Superior Court on Monday as part of the case against the tourist, Spink was running a bestiality-themed Web site from the compound.

Investigators also said it appeared Spink operated a farm where visitors could engage in twisted sex acts with animals, and they said they found images of child pornography there.

Spink was pulled over in 2005 after investigators watched five suitcases of cocaine being loaded into his Chevy Tahoe. Clopp, a sergeant at the time, was a narcotics K-9 officer and took part in the search of the vehicle.

He said the initials written on the SUV's stickers were not obviously connected to bestiality. In fact, agents researched them in case they were signals of legitimacy to other smugglers.

That's when they learned the stickers concerned groups devoted to animal-human love, Clopp said.

"Who puts stickers on their cars -- even covertly -- saying you're into bestiality?" he asked.

People who knew Spink say his actions could have been avoided.

"He is very, very charming when he meets people in social situations," said Karen Reid who breeds horses on Fox Island.

She and Spink became friends 8 years ago and he maintained her company's Web site.

"The next thing I knew, my Web site became a porno site… It was one of those many sites you can go to to access beastiality."

BELLINGHAM, Wash. - Federal agents uncover a bizarre sex operation in Whatcom County that involves animals and a business that has attracted people from all over the world.

Under the blue tarps they say people from around the world would stay as sex tourists invited to abuse animals.

Among them is 51-year-old Stephen Clarke visiting from England on a month-long trip to the U.S.

He now sits in the Whatcom County Jail on three counts of cruelty to animals in the form of bestiality.

U.S. probation officers raided the compound looking for Douglas Spink who is suspected of running the operation and maintaining a Web site displaying home video of sexual abuse against animals.

Spink, a once millionaire businessman, was on parole for felony drug charges from 2005. He was convicted of transporting hundreds of pounds of cocaine through Snohomish County and served three years.

"You'd think you've seen it all in 36 years," said Whatcom County Sheriff Bill Elfo.

He says dozens of horses and dogs were seized from the compound. Some of them were so injured they had to be euthanized.

Investigators are searching through home video taken from the compound, which could result in additional arrests.

Douglas Spink will appear in a Seattle courtroom Friday morning. He is accused of violating his parole.
It is not clear what other charges he'll face.

Animal cruelty is now a felony offense in Washington state.

Speak up - Animals from bestiality case need your help
The Whatcom County Sheriff’s office is continuing their investigation into Douglas Spink and the activities on his Suma, WA compound. Spink was arrested for parole violation last month after a federal raid on his residence turned up evidence of an animal sex operation. Read more on the history of this case here.

Spink may ultimately be charged with animal cruelty but in the meantime seven dogs and four horses removed from the scene are being cared for by the Whatcom County Humane Society in Bellingham, WA. This organization has spent thousands of dollars caring for the innocent animals at the center of this despicable operation and have now filed a motion with the courts so they may be awarded permanent custody of the animals. Until custody is decided there is a chance that Spink can get the animals back. This must not happen! They have suffered unimaginably and deserve to be kept safe, away from Spink or anyone associated with him. The Humane Society will not be able to make the necessary arrangements for the long-term care of the animals until they are awarded custody

Spink's case continued

I am happy to announce that the judge in the Douglas Spink bestiality case in Watcom County, WA has decided the fate of the seven dogs and remaining two horses that were seized when Spink and Clarke were arrested.

Clarke was convicted, Spink's criminal case is still winding it's way though court, meanwhile the judge awarded the Watcom humane society custody of all of the animals, thereby removing them from this abusive individual permanently.
