Ok, so as I've posted before, we bought a house. A nice house with a big yard for the furry babies.
We paid almost the asking price, we couldn't get our chosen possession date, and we pretty much gave in to all their conditions.

10 days ago, we were contacted by our realestate agent, who said she had good news for us, the sellers have found a new house and were willing to give us our "July 10th" requested possession. She faxed my hubby the possession admendment to sign changing the date from July 30 to the 10th.

For the past 10 days, we have been under the belief that we were getting the house July 10th. We booked trucks, and moving gear. We've hired ppl to come finish some things here at the old house ie: retaining wall repair etc.

Then about an hour ago, I get a call from my real estate agent, she asks if I'm sitting down, then proceeds to tell me that we can no longer have the amended July 10th possession date.:mad::mad:

As it turns out, she faxed the sellers agent the amended possession date that he offered, that we signed and our agent faxed back to him.
She has been calling him for the past 10 days to get a copy faxed back, he never replied back. Till today, when he told our agent that the sellers backed out of a deal to purchase a house last night, and can no longer give us our possession for the 10th of July.:frustrated:

She said we have a signed amendment, he then informed her that he didn't have his clients sign it because of some issues with the negotiation on the house they wanted to purchase.:frustrated:

I cannot even begin to articulate how angry I am at this moment. Trucks booked, ppl hired, I even have a nurse hired to care for my youngest son at her house while we do the move.:frustrated:
She is not available after the 22nd of July as her family is going on vacation.

I so wanna just punch somebody right now :wall:

To top it all off I apparently have no legal recourse,:mad:....:sad:...:cry:

Well that truly sucks! :grouphug: I think you need that hug maybe. What a crappy way for them to do business. If they were having any hesitations the agent really should have gotten back to you if even just as a courtesy. Bastid. I suppose maybe it is sadly a lesson not to count one's chickens before the eggs hatch huh. I sure hope you can get everything changed to the later date without any penalties. I really do feel for you, as if moving alone isn't stress enough... Keep your chin up though, nothing you can do about it I guess so don't let it eat you up.

Nope not much I can do at this point, however I have a call into my lawyer to get her opinion on the whole matter. Maybe I can sue them for the penalties I may face...and undue stress and such.
My lawyer is a crafty woman, if nothing else she may be able to call and put the fear of being sued into their head and force the July 10th possession.

I feel like a flippin YO YO!:frustrated: Can't stand someone messin' with my life this way, and you would think that there would be better protection for the "buyers" in a situation like this.

Sorry my grannypannies are in a bunch...I'm pissed off...can't help it.:frustrated:

Getting my hair colored at 1:30, maybe that will help me feel a bit better.:rolleyes:

Wow! That sux.

It sounds like the agent was to blame...they should have had all the "T"s crossed and "I"s dotted before contacting you! I can understand if something happened at the seller's end, but they shouldn't have contacted you until everything was settled...how unprofessional. :frustrated:

On a side note, I would definately double check anything they said they would fix in the house as part of the deal...prior to signing the final papers...

Get your nails done too - always makes me feel better.

I read about all of the problems you have had in the real estate world lately and I am very glad I bought the house I did! Yes, there were things that needed to be done before we could move in and there is a ton of stuff that we still need to do/have done. But at least we didn't have to argue with the previous owner about stuff.

That sucks...but with no amendment signed not really a lot you can do!
This happened to us when we moved here 6 years ago, the purchaser of our house wanted an earlier closing..we didn't but we gave in and gave them the Friday of the long May weekend instead of the Tues after.
AND THEN they didn't have their lawyer on the right date..no funds available for us...we couldn't get into here all our stuff on a truck and their lawyer gave them the key and they were moving in! We got to stay in a hotel and pay storage for the truck....
So good thing you know now they can't do it..not that it is much comfort....:wall::wall: some people sure aren't very considerate.

Unreal. It sounds like you've been really good buyers. The least they can do is just keep the agreement you signed and stay at a hotel for crying out loud.

So what happens if they haven't found a house by July 30? Are you going to have to wait until they find a house, however long that is? They've already gone through the hardest thing, finding a buyer for their home who met all of their conditions.

Yes met all their conditions, and thensome.

Their agent didn't have them sign the amendment, and it yet it was from them that the offer of July 10th came. It's like he is playing a game with us, unfortunately for him it's gonna end up biting him in the butt. Because while no I don't have any legal recourse, what I do have is the power of gab.
There is no better advertising than advertising by mouth, and unfortunately for him and my realtor, I like to talk...there will be no references coming from us, infact I will tell be telling ppl NOT to go to these ppl if they want proper service and respect.

So as it stands it is a July 30th possession as in the original documents. As of noon on July 30th, the house is legally rightfully completely and totally ours...and if they are still there as of noon we have the legal right to have a Sheriff escort them out and off the property. They cannot habitate after noon of the 30th, because they signed the final papers with that date.

The Calgary Real Estate Board lawyer (whom I also called), said that it was most unprofessional of him and my agent, who should've like we requested put on the amendment that there would be no more negotiation over possession, which is probably why he underhandedly didn't have them sign it.

Ohhh well, life goes on and everything happens for a reason. I was extremely angry over it but I'm chillin' out now. Got my hair done (choco brown with blonde streaks:eek:) Haven't had any blonde in my hair since I was ohhhh 18. I'm very happy with the outcome....my stylist who is a wonderful young woman deserves "awesome" advertising by mouth, just don't know if thats allowed here or not. Oh well some things are best kept secret, I already have enough trouble getting an appointment because she is sooo popular.

Anyway gonna head to the pub and have a couple beers and just chillax' with hubby and focus on the silver lining of the entire situation...which is, it gives me more time to get things done.

Most of all I'm looking forward to not having to lift my 118 lb son up and down stairs :)
