Hey all, I just had a general kind of legal question...I live in a condo that I have lived in for approx. 2 years now, and have a doberman. The condo assoc. now says that there is a convenant that dogs over 25 lbs. are not allowed. Now I have never seen this and I believe I did not sign anything at my closing or any other time. Would this pertain to me, even if I didn't sign anything?
Thanks a million for any answers!!

Where are you? States or Canada? That might make a significant difference.
However, you should have a copy of everything you signed, and if your copy of the covenants does not mention it, I don't believe they can hold you to a new rule. If they push it, seeking legal help would be a good idea.

You've lived there for two years and they are now just telling you this?
I have a friend that went thru the very same thing here, she fought it and won. We believe the real issue is that the new owners of the condo next to her, were afraid of her Pit, and the drama was caused by them.
I could never live in a condo, I just can't justify paying that much for a home, only to be told how I can or can not live, or what I can or can not have.
I would fight this, it seems suspicious to me that they are now only coming at you after 2 yrs, something isn't sitting right about that.
Good luck to you, I hope it all works out.:)

It sounds like the board made a new rule. Which is in their right.
However, there should be clauses in the new rule to account for the those who already have dogs above 25lbs.

Consult a lawyer maybe to make sure you know what your rights are. Most areas do not allow landlords/boards to dictate what you can do IN your own private residence.

I'm in SC...now this might have been in the covenant already, I just do not remember signing it. Shouldn't I have signed it at closing? And how can they tell me what size dog I can have in a condo that I own?? That's what I don't understand.

I have heard of places doing that before, it's not right if you ask me. If it is a new rule, you should be exempt from it because you already had your dog there before it, if itis an old rule and you did infact sign it, then I don't know what you can do.
